ARTICLE 1 - PURPOSE
The purpose of the General Terms and Conditions contained herein is to define the terms and conditions according to which IDOLE SARL, CINELLE PARIS brand, offers and sells Products to its clients.
These general conditions of sale will prevail over any other conditions appearing in any other document, except prior, express and written exemption.
CINELLE PARIS reserves the right to adapt or modify, at any time, the present General Conditions of Sale.
Any changes to these general terms and conditions of sale are enforceable from the moment they are posted online.
Article 1.1 : Capacity
The Internet user and/or the Customer declares to have the capacity to conclude the present Contract, i.e. to have the legal majority and not to be under guardianship or curatorship.
Article 1.2 : Destination
The Customer declares that he/she does not purchase CINELLE PARIS products and items with a view to reselling them.
To ensure the availability of our products to all our customers, particularly during promotional offers, CINELLE PARIS reserves the right to refuse to honor all or part of an order deemed abnormal, particularly in terms of the quantities of products usually ordered by a consumer.
ARTICLE 2 - ACCEPTANCE OF THE CONDITIONS
The client acknowledges having read and understood, at the time of placing the Sales Order, the present General Terms and Conditions and expressly declares to accept them unreservedly.
The present General Terms and Conditions of Sale govern the contractual relationship between IDOLE SARL, CINELLE PARIS and its clients.
ARTICLE 3 - CONFIDENTIALITY (entry into force of the RGPD, 25/05/18)
All personal data is treated confidentially and your rights to the protection of your legitimate concerns are strictly respected in accordance with legal requirements.
The collection of the Internet user's personal data is necessary in order to:
- process and deliver the order (marital status, surname, first name, postal address)
- inform him/her about the status of his/her order (phone number, email address)
- inform him about the latest trends and promotional offers of Cinelle Paris (phone number, email address)
We guarantee to our customers that we do not communicate any personal data.
ARTICLE 4 - PRODUCTS
The majority of the products proposed by the IDOLE SARL, brand CINELLE PARIS to its customers is immediately available.
However, all the products marketed by the IDOLE SARL, mark CINELLE PARIS can or cannot necessarily be the subject of sale on line.
Article 4.1 : Availability
In the event of temporaryunavailability, CINELLE PARIS undertakes within 30 days from the validation of the order, and after agreement of the Customer:
- either to deliver to the Internet user the ordered product,
- or to refund him.
In all cases, CINELLE PARIS undertakes to warn any Internet user who has placed an order for an unavailable item. In the event of a permanent stock shortage of one of the products or items in the order, the order placed will be null and void without compensation on either side.
The customer will then be contacted and will have the possibility either :
- To be refunded
- To place the order again without the out-of-stock item.
ARTICLE 5 - ORDER
The automatic registration systems are considered as proof of the nature, content and date of the Sales Order.
SARL IDOLE, brand CINELLE PARIS will confirm the client's acceptance of the Sales Order by sending a confirmation message to the client's e-mail address. The sale will only be concluded once the Sales Order confirmation has been sent.
The CINELLE PARIS brand, SARL IDOLE, reserves the right to refuse or cancel any Sales Order placed by its clients, particularly in the event of the client's insolvency or in the event of non-payment of the Sales Order in question, or in the event of a dispute concerning the payment of a previous Sales Order.
The client is exclusively responsible for any information that he or she provides when making the Sales Order. ARTICLE 6 - PAYMENT
The price invoiced to the Client is the price indicated on the Sales Order confirmation sent by .
The price of the Products is payable in cash by one of the methods of payment proposed on the site on the day the order is placed.
You can pay the products by credit card (CB, Visa, Mastercard) or by PayPal.
The maximum amount that you can spend on a Sales Order depends on the payment method you select and whether you are a registered user or a guest.
The Order validated by the client will only be considered effective once the secure bank payment center has given its approval of the transaction and, if applicable, after acceptance of the risk by the insurer.
Article 6.1 : Secure payment
When the Internet user pays by credit card, he/she is invited at the end of the order to indicate his/her card number, the date of validity and the last three digits on the back of the card. Various accesses to authorization distributors are then carried out in order to verify the data to avoid abuse and fraud. To do this, the server is in encrypted mode and all the information transmitted is coded. None of this data is transmitted unencrypted on the Internet.
In all cases, the online provision of his card number and the final validation of his order will be worth proof of the integrity of the order and the payability of the sums due in execution of said order.
This validation is worth express acceptance of all operations carried out on the Site.
Article 6.2 : Security devices
To ensure the security of payments, the site uses the secure payment service of the Caisse d'Epargne. This service integrates the 3D-SECURE.
The confidential data (the 16-digit credit card number and the expiration date) are directly transmitted encrypted on the server of the Caisse d'Epargne without passing through the physical supports of the server.
When the order is validated, the payment request is routed in real time to the Caisse d'Epargne secure remote payment manager. The latter sends an authorization request to the bank card network. The remote payment manager issues an electronic certificate.
ARTICLE 7 - DELIVERY
Once the Sales Order has been confirmed, and subject to full payment of the Product(s) ordered by the client, will ship the Product (s), under responsibility, to the client or recipients address within workdays for orders placed from Monday to Friday, subject to availability.
All Products set out in the Sales Order transmitted to are strictly reserved for personal use by the client or the recipient explicitly mentioned under the recipient address information.
If necessary, the client will ensure that all taxes, rights and/or other shipping charges, including the Products themselves, are paid upon receipt of goods; it being understood that shall in no way be held responsible for making said payments.
The customers or the recipients of the Products prohibit themselves any partial or total resale of the Products.
Delivery will be made by Colissimo or Mondial Relay according to your convenience.
The delivery costs in France are :
- 3,90€ for a delivery by Mondial Relay (under 48h/72h, price variable according to the weight of the parcel)
- 7,90€ for a delivery by Colissimo Domicile (under 48h/72h, price varies according to the weight of the parcel)
- Free delivery from 50€ of purchase for a delivery in a relay point with Mondial Relay in Metropolitan France
Any order placed on Friday after 12:00 am will be processed from Monday of the following week. Similarly, any order placed on a holiday will be processed the next business day.
In the event of a delay in delivery exceeding seven (7) days, the Customer may, if he/she so wishes, and except in cases of force majeure, cancel the sales contract by registered letter with acknowledgement of receipt. This right must however be exercised within sixty (60) working days from the delivery date initially provided for in the contract.
The delivery costs in France overseas are :
- For Guadeloupe, Martinique, Mayotte, Reunion Island, Guyana from 45€ in Colissimo signature
The delivery fees for foreign countries are :
- Zone A (Germany, Belgium, Luxembourg, Netherlands, Monaco) from 12€ in Colissimo signature
- Zone B (Spain, Italy, United Kingdom) from 16€ in Colissimo signature
- Zone C (Austria, Portugal, Denmark) from 17€ in Colissimo signature
- Zone D (Finland, Sweden, Switzerland, Norway, Liechtenstein) from 16€ in Colissimo signature
- Zone E (Greece, Poland, Czech Republic, Slovakia) from 23€ in Colissimo signature
Upon receipt of the ordered Products, the customer or the recipient must check the good condition of the delivered Product.
In the event that one or more of the ordered Products are missing or damaged, the client or recipient must make any reservations to the carrier within 24 hours of delivery.
In the event of visible defects, the client has the right to return the Product(s) under the conditions indicated in the Product's owner's manual.
In the event that the client wishes to return the Product(s), the client will have the right to do so at any time.
Should the client require delivery of the Products ordered to two different addresses, two separate orders will be placed.
All orders are processed within 24 hours from Monday to Friday (except on public holidays) subject to validation of payment. Packages are generally dispatched within 2 days after receipt of payment. They are shipped via La Poste - Colissimo with a tracking number and delivered without signature. Whichever shipment choice you make, we will provide you with a link to track your package online.
Shipping fees include preparation and packing fees as well as postage costs. Preparation fees are fixed, while shipping fees vary according to total weight of the package. We recommend that you group all your items in one order. We cannot group two distinct orders placed separately, and shipping fees will apply to each of them. Your package will be dispatched at your own risk, but special care is taken to protect fragile objects.
Boxes are sized appropriately and your items are properly protected.
You have the choice between several modes of delivery:
Packages are delivered in one of the 6000 Relay Points of the Mondial Relay network within 48 to 72 hours*. This delivery is charged 3.90 € TTC and it is free for any order superior or equal to 50€ for a delivery in Metropolitan France.
La Poste - Colissimo
Have your order delivered where you want it in Metropolitan France within 48h to 72h*. This delivery is charged 8.90 € TTC (price varies according to the weight of the package).

For deliveries outside of Metropolitan France, deliveries are made exclusively by La Poste.
La Poste - Colissimo with signature
Have your order delivered where you want it in Metropolitan France with delivery against signature for a period of 48h to 72h*. This delivery is charged 9 € TTC (price varies according to the weight of the package).

For deliveries outside of Metropolitan France, deliveries are made exclusively by La Poste.
ARTICLE 8 - RETURNS AND REFUNDS
The customer has a period of 30 days from the date of invoice, without undue delay, to return the products and the standard withdrawal form (return form).
Items on sale have a delay of 15 days as from the date of invoicing, without excessive delay, to return the products to us as well as the standard form of retraction (return form).
The return costs are at the customer's expense.
If you are not able to print the return form, please write all the information requested on the back of the invoice.
In this case, the customer will have to send back the new Products, intact, packed, accompanied by all the possible accessories, instructions for use and documentations to the following address

In the event of exercise of the right of retractation, the IDOLE SARL, mark CINELLE PARIS is committed refunding the sums paid by the customer, without expenses, except for the expenses of return.
The refund is due within 10 days maximum.
The jewels, the masks, the dresses masks, the lingerie and the tights are neither taken back, nor exchanged.
Once your returned products have been checked and inspected in our warehouse, you will receive a refund notification by email if a refund is granted.
To do this, pack the item(s) to be returned in the original packaging with the order invoice and return slip in the package.
Then send it to the above address.
Your refund will be credited back to the card or account you used to place the order as soon as possible.
Generally, refunds appear on your statement after 8-10 business days. This time frame depends solely on the practices of your card issuer. You can always check the status of your refund on your online account or by contacting your card issuer.
In order to obtain a full refund, it is important that we receive the returned products in the condition in which you received them: the returned products must be complete, unworn or unwashed, and all their labels must be intact.
The refund is due within a maximum of 10 days.
ARTICLE 9 - PRICE
The price is expressed in euros.
The price indicated on the Product Sheets does not include shipping costs.
The price indicated in the Order Confirmation is the final price expressed inclusive of all taxes and including VAT. This price includes the price of the Products, handling, packaging and storage costs for the Products, transport costs and commissioning costs.
CINELLE PARIS reserves the right to change prices at any time but undertakes to apply the prices in force at the time of validation of the order by the Customer.
If one or more taxes were to be created or modified in rise as in fall, this change could be reflected on the selling prices of the products and documents of sale.
ARTICLE 10 - PROMOTIONAL OFFER
CINELLE PARIS promotional offers (promotional codes) are limited to one per customer and per order. It is not possible to combine promotional codes.
If you have a promotional code, enter it on the shopping cart page, in the Promotional Code field, and click on Apply. Please check the expiration date of your promotional code before using it. Note: You cannot use more than one promotional code for the same purchase. Please note: if you use promotional codes for discounted products and the total discount is more than 50% of the original price, the promotional code may not be applicable. Each promotional code is valid for one use only, unless otherwise agreed.
ARTICLE 11 - APPLICABLE LAW
The present general conditions of sale are subject to French law.
ARTICLE 12 - RESPONSIBILITY
shall not be held liable for bodily or material damages incurred to any third party resulting from improper use of the Products.
In the event of difficulties in the application of this contract, the customer and the IDOLE SARL, mark CINELLE PARIS reserve the possibility, before any action in justice, to seek a friendly solution.
Failing that, any legal action will be brought before the competent courts of the defendant's domicile or the place of delivery or the jurisdiction of CINELLE PARIS' head office.
ARTICLE 13 - GUARANTEE
In all the cases the IDOLE SARL, mark CINELLE PARIS could not be held for person in charge of the nonrespect of the regulatory and legislative provisions in force in another country of reception that France.

ARTICLE 14 - LEGAL INFORMATION
The personal information collected for the purposes of distance selling is mandatory, this information is essential for the processing and delivery of orders, the establishment of invoices and contracts of guarantee. Failure to provide this information will result in the non-validation of the Order.
In accordance with the French "Informatique et Libertés" law, the processing of personal information concerning the client has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL).
The customer has (article 34 of the law of January 6, 1978) of a right of access, modification, correction and suppression of the data which concern it, which it can exert near ITIS COMMERCE. Moreover, the IDOLE SARL, mark CINELLE PARIS makes a commitment not to communicate, free or with counterpart, the co-ordinates of its customers to a third.
ARTICLE 15 - SPECIAL CONDITIONS
15.1 In the event that the Products ordered are not available, the Sales Order will not be accepted for replenishment in successive shipments to the client.
ARTICLE 16 - INTELLECTUAL PROPERTY
CINELLE PARIS is the owner of the rights to the texts, images (animated or not), general architecture, graphics, and thus the entire contents of the Site.
In accordance with Article L122-4 of the Intellectual Property Code, any representation or reproduction of the content, in whole or in part, by any means whatsoever, without the consent of CINELLE PARIS is illegal. It is the same for the adaptation or transformation, translation, arrangement or reproduction by any art or process.
Violation of the provisions of Article L122-4 of the Intellectual Property Code constitutes an infringement within the meaning of Article L335-2 of the same code, which constitutes an offence.
No provision of these General Terms and Conditions of Sale and Use may be interpreted as granting the Internet user a right of any kind whatsoever over the elements protected by intellectual property, which CINELLE PARIS may own or have the exclusive right to use.
In any event, any link, even tacitly authorized, must be removed upon request by CINELLE PARIS.
ARTICLE 17 - COMPLETENESS OF THE CONTRACT
These General Terms and Conditions of Sale concluded between CINELLE PARIS and the Internet user express the entirety of the rights and obligations of the parties.
No document, no indication, no correspondence can generate obligations under these General Terms of Sale unless they are the subject of an amendment signed by both parties.
If a particular provision of these General Terms and Conditions of Sale is held to be invalid or declared as such by a final decision of a competent court or if one of the clauses of these Terms and Conditions is rendered null and void by a change in legislation or regulations, the other provisions shall retain all their force and scope.
This will not affect the validity and the respect of the present General Conditions of Sale.
